Theodor W. Adorno’s writings are often categorized as either political, aesthetic or critical. While all of these characteristics are legitimate, it is problematic to view Adorno from only one of these angles. In fact, many literary critics consider his thoughts about literature to be simple cultural criticism, i.e., something that leaves the realm of pure scholarship by defiling the argumentation with philosophy or politics. Political theorists and philosophers, on the other hand, often view his literary concerns as superfluous. It is (...) my thesis that Adorno’s way of thinking can only be adequately understood when these categories are not seen as mutually exclusive. In order to demonstrate this point, I will concentrate on his use of the term realism which can be seen as paradigmatic for this question. (shrink)

Whereas traditional ethical discussions of suicide have primarily dealt with questions relating to the moral rightness or wrongness of suicidal acts, the problem of which moral criteria should govern acts of preventing, admitting and aiding suicide has rarely been discussed systematically. In the present paper it is argued that suicide is morally neutral in all cases in which it does not constitute grave damage, material or psychological, to others, that this does not imply that non-prevention, in the same range of (...) cases, is morally neutral as well. Moral criteria for suicide prevention are formulated by making use of the Rawlsian device of a fictitious “veil of ignorance” behind which moral rules are decided on from merely self-regarding motives. It is argued that decision behind the veil would be of a principle of “restricted paternalism” that minimizes both the risk of not being prevented from committing suicide in cases in which this is clearly irrational in view of the enduring preferences of the suicidal person himself, as well as the complementary risk of being subjected to compulsory detention or treatment in cases in which suicide is the option conforming most, on a realistic view of the case, to the enduring preferences of the person. The practical rules translating the principle into concrete practice comprise a rule demanding compulsory prevention of all imminent suicides by persons not intimately known to the potential preventer, a prohibition of pre-emptive compulsory measures, and a general temporal limitation on detention. Finally, a similar, if more tentative, derivation of practical rules is attempted for cases in which aiding a suicide might seem to another person to be in the best interest of the suicidal person concerned. Our starting point is the question ‘What is mass’, what in particular enables mass to constitute duration: so that mass can be regarded as moving as well as at rest (the kinematic principle of relativity). In a thought experiment, this question is attacked here not from the perspective of mass itself, but from that of a standing light wave. In this model, mass-analogous structures can be re- constructed that can be in relative motion to each other. The (empirically known) constancy (...) of the speed of light in every reference system is not as- sumed here. However, it can be shown that the speed of light is identical in all systems constituted by mass-analogous structures that move uniformly relative to each other and that the speed of light moreover is the limiting speed of mo- tions. This indepence of the motion of light from the system of reference, this character of absoluteness, and the relativity of mass motions thus prove to be contrary but inextricably linked moments of the kinematic principle of relativi- ty: an interesting perspective concerning a philosophy of relativity theory. - The mathematical relationships are explained in more detail in the appendix. Ausgangspunkt ist die Frage, was Masse ist, wodurch sie insbesondere befähigt ist, Dauer zu konstituieren und deshalb - im Sinn des kinematischen Relativitätdprinzips - ebenso als bewegt wie als ruhend betrachtet werden kann. In einem Gedankenexperiment wird diese Frage, in Umkehrung der Perspektive, hier nicht von der Masse selbst, sondern von einer stehenden Lichtwelle her angegangen. In diesem Modell lassen sich masse-analoge Strukturen rekonstruieren, die in relativer Bewegung sein können. Die (empirisch bekannte) Unabhängigkeit der Lichtgeschwindigkeit vom Bezugssystem ist dabei nicht (...) vorausgesetzt. Doch kann gezeigt werden, dass die Lichtgeschwindigkeit Grenzgeschwindigkeit solcher relativer Bewegungen ist, dass dies für alle durch masse-analoge Strukturen konstituierte, relativ zueinander gleichförmig bewegten Bezugssysteme gilt und dass die Lichtgeschwindigkeit selbst in allen diesen Systemen gleich ist. Die Absolutheit der Lichtgeschwindigkeit und die Relativität der Massebewegungen erweisen sich so als zwar differente, aber intrinsisch zusammengehörende Momente des kinematischen Relativitätsprinzips: ein Beitrag zu einer Philosophie der Relativitätstheorie. - Die mathematischen Zusammenhänge werden im Anhang ausführlicher dargelegt. Autor rozpatruje - w kontekście dyskusji na temat eutanazji - argumenty przemawiające za stosowaniem silnych środków pozwalających uśmierzać ból i cierpienie w fazie terminalnej, jak też przemawiające przeciwko takiemu postępowaniu. W efekcie zestawienia ze sobą jednych i drugich argumentów dojść można do wniosku, że stosowanie środków uśmierzających jest zachowaniem o wiele bardziej wskazanym, aniżeli wspomaganie przy samobójstwie. Nie należy z tego jednak wyprowadzać wniosku, że jest to jedyna moralnie akceptowana opcja. Wniosek, do jakiego dochodzi autor, brzmi mniej więcej następująco: oba (...) sposoby postępowania są moralnie akceptowalne, atoli jeden z nich jest bardziej wskazany czy korzystny. Poza tym trzeba jeszcze wspomnieć o jednym: podczas gdy można wskazać racje przemawiające przeciwko temu, by obowiązkiem lekarza uczynić asystowanie przy samobójczym akcie cierpiącego pacjenta, to tak samo można wskazać racje przemawiające za tym, by zobowiązać lekarza do tego by w tych samych okolicznościach - przy założeniu, że jest to jedyny sposób uśmierzenia bólu - uczynić obowiązkiem lekarza to, by w danych okolicznościach podał pacjentowi silne środki uśmierzające ból. Autor skłonny jest nawet pójść dalej i przyznać pacjentowi prawo żądania w określonych okolicznościach podania środków uśmierzających ból w stanach terminalnych. Jedną z racji przemawiających za tym jest, według autora, żywotne zainteresowanie pacjenta tym, by w ostatnich chwilach swego życia być uwolnionym od cierpienia. (shrink)

Die Studie unterscheidet sich durch die Konzentration auf die spezifisch natur- bzw. vernunftrechtlichen Lehrstücke des Strafrechts von entsprechenden Forschungen in den benachbarten Disziplinen wie der Strafrechtsgeschichte oder den Kulturwissenschaften. Die Untersuchung hat gezeigt, dass die Strafrechtsphilosophie der neuzeitlichen Naturrechtslehre ein Ergebnis einer Anwendung säkularer Prinzipien auf das Problemfeld staatlicher Strafe ist. Behandelt werden die strafrechtstheoretischen Überlegungen von Grotius, Hobbes, Pufendorf, Wolff, Beccaria und Kant im Hinblick auf die Frage nach dem Ursprung bzw. Geltungsgrund der Strafkompetenz und dem Strafzweck (Abschreckung, Besserung (...) oder Vergeltung). Darüber hinaus werden die Gründe der Affinität der Strafrechtstheorie zu deterministischen psychologischen Modellen sowie die Kritik der kriminalpolitischen Aufklärung an der Strafpraxis des Ancien Régime untersucht. Weil die Naturrechtslehrer im 17. und 18. Jahrhundert in erster Linie an der philosophischen Rechtfertigung der Strafe bzw. der Legitimation der staatlichen Strafgewalt interessiert sind, spielen die soziologischen oder gesellschaftstheoretischen Aspekte der Kriminalität bei ihnen kaum eine Rolle. Die Naturrechtstheoretiker interessieren sich m. a. W. nur für die Geltungsbedingungen des Strafrechts, während die Fragen der Genesis kriminellen Verhaltens weitgehend ignoriert werden. Aber gerade die Konzentration des Blicks auf die spezifisch rechtsphilosophischen Argumetationen eröffnet einen neuen Blick auf die Strafrechtsphilosophie der Aufklärungsepoche. (shrink)

Eschewing talk about a strong or weak will, I view the will of the dieter to be essentially identical to that of the normal eater, and say they differ only in the luck of their circumstances. However, I adopt a compatibilist approach to the will, generally, such that the dieter, despite having unlucky circumstances, is responsible for her efforts to lose weight. I base this on Hook's view that a person does not know what she can do before (...) doing it, and that she can "redetermine the direction of events" through effort. But a model of "redetermining" the will in which this is a conscious activity is insufficient to address the dieter's problem. I advocate consideration of another dimension of experience, based on the psychoanalytic theory of D.W. Winnicott, in which creative insight arises from the unconscious true self. I suggest that creative insight bypasses the will to radically change the dieter's perspective in a way that conscious strategies alone cannot achieve. I conclude that freedom is possible on the basis of conscious willing and in tapping the unconscious true self. (shrink)

Na pytanie o rozumienie pojecia przyrody udzielano w historii filozofii różnych odpowiedzi. W książce Mutschlera możemy znaleźć obszerny przegląd współczesnego rozumienia tego pojecia. Zasadniczy przełom w poglądach na przyrodę dokonał się na początku XVII wieku, kiedy to przy jej badaniu zaczęto się odwoływać do powtarzalnych eksperymentów, do metod ilościowych oraz do matematyki. Przykładem takiego postępowania jest metoda zaproponowana przez Galileusza, dla którego „księga przyrody" jest napisana w języku matematyki. Przed Galileuszem nikt nie wpadł na pomysł, zęby przyrody traktować jako księgę (...) napisaną w języku matematyki. Zwrotu „księga przyrody" lub „księga natury" używano już w średniowieczu i przeciwstawiano „księdze objawienia". Tego rodzaju przeciwstawienie odpowiadało równocześnie podziałowi na to, co „naturalne" i na to, co „ponadnaturalne". (shrink)

An attempt to present a classification under which all the law can be brought into scientific arrangement.

We defend a functionalist approach to emotion that begins by focusing on emotions as central states with causal connections to behavior and to other cognitive states. The approach brackets the conscious experience of emotion, lists plausible features that emotions exhibit, and argues that alternative schemes are unpromising candidates. We conclude with the benefits of our approach: one can study emotions in animals; one can look in the brain for the implementation of specific features; and one ends up with an architecture (...) of the mind in which emotions are fully accommodated through their relations to the rest of cognition. Our article focuses on arguing for this general approach; as such, it is an essay in the philosophy of emotion rather than in the psychology or neuroscience of emotion. (shrink)
